How to Modify an EOR Contract

The Aspire EOR platform allows you to submit modification requests for your EOR employee contracts at any point. This guide walks you through requesting employment term changes and navigating the approval workflow.


Pre-requisite

Amendment requests can only be submitted after the Quote has been accepted.

  • Before a Quote is accepted, you have the flexibility to directly edit the agreement without going through the amendment process.

  • The amendment workflow is for modifications to signed agreements. If the Quote remains unsigned, you can make edits without creating an amendment.


What you can modify

You can request changes to various aspects of an EOR contract, including:

  • Compensation (currency restrictions may apply based on the employment country)

    • Salary

    • Variable compensation

    • Fixed Allowances

  • Job title and scope

    • Job title

    • Seniority level

    • Job scope

  • Working hours and absences

    • Employment type

    • Work schedule

    • Time off

    • Sick leave

  • Contract duration and conditions

  • Employment type

    • Start date (if it has not yet passed)

    • Probation

  • Employee personal details

    • Employee nationality

    • Country/State employee will be working from

  • Contract actions

    • Entity transfer

Notes:

  • Specific modifications may trigger legal review requirements, country-specific limitations, require employee signatures, or result in a change to the deposit amount.

  • Any amendment related to the start date or salary increase must be submitted prior to the applicable country's cut-off date in order to be included in that month's payroll. Amendments processed after the cut-off date will be applied in the following month's payroll cycle.

Request custom changes

When a field cannot be modified directly within the platform, you may submit a custom amendment request for Deel's review.

Custom amendment submissions will require Deel to review, draft, and send applicable amendment documents for signature if needed.

Modifications requiring employee authorization will trigger automatic generation of the Work Order Form amendment. Note that Employee Agreement amendments still require the employee's signature separately.


What you cannot modify

  • Type of hire: Demotion from Manager > Employee

    • You can not demote from Manager to Employee if the Employment Agreement has been signed by the employee, but it is possible to demote if the EA hasn’t been signed.

  • Standard working schedule

    • We can not force full-time employees to work hours in a different time zone than their employment country.

    • For example, US employees can not work a standard working day based on Australian hours.

  • Decrease in salary or holiday days below the statutory minimum

    • The employee must have the minimum number of holiday days and salary, as per their employment country’s national law.

    • National bank and public holidays in the employment country have to be observed, but not public holidays in the employer's country.

  • Backdating employment start dates is not allowed once payroll has been processed

    • Please ensure that all employment details are correct before payroll cut-off to avoid issues.

  • Create an ‘unlimited PTO' policy

    • You can leave the time off as standard in the contract and make a direct arrangement with your employee, if you wish. However, due to compliance reasons, we need a definitive set number of PTO days in the employee’s agreement.

  • End date

    • We can't change the contract termination terms from an indefinite period to a definite period if the employee has already signed their agreement

  • Employee's full legal name

    • Minor typos and edits may be processed as an on-platform amendment, pending the Deel EOR group review

  • Mentioning Deel or Employer Details in Work Order Form

    • The Work Order Form must be generic to the role


How to submit a contract change request

Access the contract

  1. Log in to your Aspire account.

  2. Click "Employer of record" in the left navigation bar.

  3. Click "Go to Aspire EOR".

  4. Navigate to the People tab.

  5. Select the employee whose contract you wish to modify.

Modify the contract

  1. On their profile, click "View agreement".

  2. Next, click "Request changes".

  3. Update the relevant fields with your desired changes.

  4. Select the effective date of when these changes apply.

  5. Review the requested changes and click "Submit".

It will take approximately three to five business days to process advanced amendment requests and send documents.

Some contract changes will not require an additional review and approval, while other requests will require an internal review that may take several business days.

Legal amendments undergo review by our internal team. You cannot submit additional amendment requests while an active request is still under review. Please include all your known amendment requests at one time.


Frequently Asked Questions

Do I need to pay an additional deposit to make contract changes?

This depends on the nature of your amendment request.

Modifications that increase an employee's potential severance payment upon termination may trigger an additional deposit requirement. Examples include eliminating probation periods, expanding vacation allocations, or raising salary.

We maintain a two-month deposit maximum per EOR agreement throughout the contract lifecycle, including the initial deposit collected at contract creation.

Should a gap exist between this two-month deposit ceiling and the amount required for your amendment, we may charge the difference.

Why has my amendment been rejected?

We maintain strict compliance standards for all amendment requests. Rejections typically occur when proposed changes fail to meet legal compliance requirements. For further discussion, please contact your Aspire representative.

Will I know why an amendment request was rejected?

Yes. All amendment rejections are accompanied by an email clearly detailing the specific reason for denial.
